These term and Condition apply to the Tans’ Plumbing and Gas (“Tan’s Plumbing” “we” “us” or “our) website and associated pages (the “Site”) as well as the provision and sale of products and services by Tan’s Plumbing. By accessing or using this site and our service, you are agree to be bound by these Terms and Conditions, all application by laws and regulations, If you do not agree with these terms, do not use this site.

We reserves the right to a make changes to this Site and to these Terms and Conditions at any time without prior notice. You should review these Terms and Conditions each time you access to our Site. You also agree that we may provide all legal communications and notices to you electronically by posting them on this Site or by sending an email to the email address you provided to us. The Owner allows Users to upload, share or provide their own content to this Website.

TERMS AND CONDITIONS OF SALE

Any and all works carried out by us either quoted or otherwise will be subject to these terms and conditions in full. It is the sole responsibility of the customer to read these terms and conditions.

Methods of payment

Information related to accepted payment methods are made available on tax invoice.

Some payment methods may only be available subject to additional conditions or fees. In such cases related information can be found in the dedicated section of this Website or on tax invoice.

All payments are independently processed through third-party services. Therefore, this Website does not collect any payment information – such as credit card details.

All payments must be paid via cash/EFT or credit card Payment on or before due date of invoice.

Any payments which fall overdue shall incur a non-negotiable late fee of $40 with interest incurring monthly at 10% until paid in full.

Credit card payments will incur a surcharge of 2.0%.

All quoted works are subject to variations as required & are at the discretion of Tan’s Plumbing and Gas in order to carry out & complete works to Australian & Safety Standards. All variations will incur further fees & charges in addition to the original quoted amount.

Rates and Charges

Our Standard hourly rate is $130.00 plus GST per hour from tradesman arriving onsite unless quote specified.

Emergency rates is $300.00 which includes the first hour of labour and $220 for the following hour.

Emergency rates/ charges will apply outside of normal business hours.

Cancellation policy

Customer must provide at least 24 hours of any cancellation of work. Failure to do so will incur a $80 fee.

We reserve the right to cancel any order where after confirmation, We become aware of shortages, delays or out of stocks for any unforeseen circumstances

Return and Exchange of Goods

Any returns must be made within 30 days in their original package, unused, undamaged or resaleable condition.

A minimum of 30% restocking fee will apply for change of mind returns. Subject to Australian Consumer Law, customer may be required to pay for amounts Tan’s Plumbing incur as a result the cancellation or return. (No refund for any delivery fees or transport costs)

Goods that are sold “As Is” or refurnishing goods are non-refundable, unless there is a major fault with product that we have not notified you of.

Warranty information

Manufacturers warranties may apply to the Goods purchased and in addition, if you are a Consumer, we provide additional warranties in accordance with Australian Consumer Law(ACL).

As a Consumer you are entitled to a replacement or refund for a major failure or a repair or replacement for a minor failure.

Tan's Plumbing and Gas does not warranty any customer supplied goods or parts.

Customer shall inspect for any Goods and works on completion and must report any defects within 48 hours in writing to us of any alleged defects or damage. Subject to this clause, we will not accept any liability for any goods or works defects outside this 48 hour period. For the avoidance of double, this does not limit or exclude any rights you may have under ACL.

No warranty shall be provided for any blocked waste pipes, drainage, sewer or storm water.

We will not be liable for damage, loss or injury suffered as a result of any person, failing to follow instructions relating to the Goods, modifying the Goods, failing to appropriately maintain the Goods, failing to appropriately store them or using them for an unintended purpose.

Limitation of Liability

Nothing in these Terms excludes, restricts or modifies any guarantee, condition, warranty, right or remedy which the User may have under the Competition and Consumer Act 2010 (Cth) or any similar State and Territory legislation and which cannot be excluded, restricted or modified (non-excludable right). To the fullest extent permitted by law, our liability to the User, including liability for a breach of a non-excludable right and liability which is not otherwise excluded under these Terms of Use, is limited, at the Owner’s sole discretion, to the re-performance of the services or the payment of the cost of having the services supplied again.

Customer hereby agrees that Tan’s Plumbing and Gas is solely responsible for evaluating the Good or Services and determining whether the Good or Services are fit for Customer’s purpose.

You hereby agree that we are not liable for any direct, indirect, consequential or incidental loss or damage which may result from you use of the Good or Services

Indemnification

You agree that you shall indemnify Tan’s Plumbing and all site editor and officers, directors, employees, business owner, independent contractors, from any claim or demand, including reasonable legal fees, and expenses arising out of related to your breach of these Terms and Conditions or any suit , claim or demand arising from or relating to any text, photograph, image, graphic or other material that was not part of the standard Site content.
